By accessing or using abilities.ca (the “Site”), you agree to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, you should not use the Site.

2. About us

Abilities.ca is operated by BCS Communications Ltd. for the Canadian Abilities Foundation, a Canadian registered charity dedicated to supporting people with disabilities across Canada.

3. Permitted use

The Site and its content are provided for your personal, non‑commercial use and for informational and educational purposes. You agree not to:

  • Use the Site in a way that violates any applicable law or regulation.
  • Attempt to interfere with the security, integrity, or availability of the Site.
  • Use any automated system (such as bots, spiders, or scrapers) to access the Site without our prior written permission.
  • Use the Site in a manner that could damage, disable, overburden, or impair our servers or networks.

4. Intellectual property

All content on the Site, including text, images, graphics, logos, videos, and design (the “Content”), is owned or licensed by BCS Communications Ltd., the Canadian Abilities Foundation, or our content providers and is protected by copyright and other intellectual property laws.

You may view, download, and print Content for your personal, non‑commercial use, provided you do not remove any copyright or other proprietary notices. Any other use, including reproduction, modification, distribution, or republication of Content for commercial purposes, requires our prior written consent.

5. User submissions

If the Site allows you to submit comments, stories, or other materials (“User Content”), you are responsible for that User Content and for ensuring that you have all necessary rights to share it.​

By submitting User Content, you grant us a non‑exclusive, royalty‑free, worldwide licence to use, reproduce, modify, publish, translate, distribute, and display such content in connection with our programs, publications, and online platforms, in any media now known or later developed, for purposes consistent with our mission.

We reserve the right (but have no obligation) to review, edit, or remove User Content that we consider inappropriate, offensive, or inconsistent with these Terms.

The Site may contain links to third‑party websites, including CanadaHelps and other resources. These links are provided for convenience only. We do not control and are not responsible for the content, privacy practices, or terms of those third‑party sites. Your use of third‑party sites is at your own risk and subject to their policies.

7. Donations

Online donations to the Canadian Abilities Foundation are processed through CanadaHelps, a third‑party platform. When you click a donation link or button, you may be redirected away from abilities.ca to a CanadaHelps website.

Donations made through CanadaHelps are subject to CanadaHelps’ own terms of use and privacy policy. We are not responsible for the availability, accuracy, or security of CanadaHelps’ websites or services.

8. Disclaimers

The Site and its Content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. While we strive to provide accurate, current, and useful information, we do not represent or warrant that:

  • The Site will be uninterrupted, secure, or free of errors or omissions.
  • The Content is complete, reliable, or up to date.

11. Governing law

These Terms and your use of the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without giving effect to any conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts of Ontario for any disputes arising out of or relating to the Site or these Terms.
